True, a bank card is also easy to lose and, therefore, to find. What to do if someone else’s card fell into your hands, Ivan Solovyov, Honored Lawyer of Russia, told Sputnik radio.
“If you happen to have someone else’s bank card, you must act in exactly the same way as if you had someone else’s wallet in your hands. No need to try to pay anything with it or transfer money to it in order to draw the attention of the owner to the fact of loss. As soon as you remove something from it, you will commit theft. The law makes this clear. In addition, if the attackers withdrew some amount from this card before you, it will be difficult for you to prove that it was not you who did it, ”the expert explained.
According to Solovyov, any use of someone else’s card can lead to prison. The penalty will depend on the amount spent and starts from a two-year term. And if you decide to drink beer with your comrades, then this is qualified as a crime committed by a group of people. And even if they meet you halfway and give you a suspended sentence, the fact of being prosecuted will do you a disservice.
Therefore, if you find someone else’s card, it is better to get rid of it immediately and in no case carry it with you and do not look for the owner. The easiest way is to destroy it, but you can also call the bank that issued it, or take it to the nearest branch of this bank.
